Minimum tobacco sales age now 21

It is now illegal to sell or provide tobacco to anyone under the age of 21. That results from a law passed by Congress in December, 2018. Although the U.S. Food and Drug Administration (FDA) may not enforce the minimum age of 21 until they update their own rules, it is still federal law. The Nebraska minimum age to buy or use tobacco products is now 19, and that is what Nebraska law enforcement agencies may be enforcing, rather than the minimum federal tobacco sales age. However, it is still a violation of federal law to provide tobacco to anyone under the age of 21.

National and Nebraska minimum age laws apply to electronic cigarettes as well as to cigarettes, chewing tobacco and all other forms of tobacco.
